The separation started when he got arrested for intoxication. This led to the first crack between him and his wife. Lane’s step mother helped her to get everything she wanted, when she got separated from her husband. Both Josh and Lane were married before and they wanted to make the separation, as smooth as possible, to avoid more rumors and public interference. The intoxication arrest was not the starting point of the separation. Lane called the police against Josh, just four months after the wedding and claimed that he hit her. Nevertheless, she did not press charges against him. The other reason for the separation was stated that his career was stagnant while Lane was getting more popular and he was not comfortable with that. The reason for separation for any marital relationship may be alcohol, abuse or affair. However, when it comes to his separation, all three acted together.  It was said that he was having an affair with Melissa Green. There were pictures in which Melissa was sitting on his lap, kissing each other and many other intimate pictures, taken in a bar. It was said that they spent the whole night at the bar. This happened when he was married to Lane. After the separation, he went to rehab and returned. After the separation, he was seen kissing Kathyrn Boyd.

Though there were several reasons to state, Lane just stated irreconcilable differences as the reason for separation. When asked about the spousal battery, she said that Josh hit her and she called the police. But when the police came, she did not want to make a big scene out of it and did not press any charges. The sources close to Josh said that the pictures of him kissing Green were not clear enough to be taken as an evidence. It was a dim lit bar and the picture was a bit shaky. It just looked like he hugging another girl and the girl resting her head on his shoulder. It was said that it would have been a picture taken at the right time to make an innocent hug look like an intimate kiss. The rumors did not die because of this explanation for two reasons. The first reason was that none of the parties involved commented on the picture and why they both were there till morning. The second reason was that there were a lot of people who saw Melissa walking out of the bar, embarrassed and hungover. Thus, the affair part was proved by the picture.
